Terms of Service

2. Scope of Services
The Company provides startup incubation, development, and consulting services as described on this website. The specific scope, deliverables, timelines, and pricing for each engagement will be agreed upon in a separate statement of work (SOW) or service agreement prior to commencing any project.

3. Intellectual Property
Upon full payment of all applicable fees, the Company assigns to the client all intellectual property rights in the deliverables specifically created for that client under the applicable SOW. The Company retains ownership of all pre-existing materials, frameworks, tools, and general know-how used in the delivery of services.

4. Payment Terms
Unless otherwise specified in the applicable SOW, invoices are payable within 14 days of issuance. Late payments may incur interest at the rate of 1.5% per month. The Company reserves the right to suspend work on any project if payment is overdue by more than 7 days.

5. Confidentiality
Both parties agree to maintain the confidentiality of all proprietary information shared during the course of the engagement. Neither party shall disclose confidential information to third parties without prior written consent, except as required by law.

6. Limitation of Liability
To the maximum extent permitted by applicable law, the Company's total liability for any claim arising out of or related to these Terms or the services provided shall not exceed the total fees paid by the client for the specific service giving rise to the claim. The Company shall not be liable for indirect, incidental, consequential, or punitive damages.

7. Termination
Either party may terminate a service engagement with 14 days' written notice. In the event of termination, the client shall pay for all work completed up to the termination date. Work products delivered prior to termination remain the property of the client, subject to full payment.

8. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Denmark. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Denmark.

Refund Policy

1. General Policy
At nextgenerationstack, we are committed to delivering high-quality services. Refund requests are evaluated on a case-by-case basis in accordance with the project milestones and deliverables outlined in the applicable statement of work (SOW).

2. Pre-Project Refunds
If you wish to cancel a project before work has commenced, you are entitled to a full refund of any advance payments made, provided that written notice of cancellation is received within 7 days of payment.

3. Partial Refunds During Active Projects
For projects in progress, refunds will be calculated based on the percentage of work completed at the time of cancellation. Work that has been delivered and accepted by the client will not be subject to refund. The client will receive a detailed breakdown of completed work and associated costs.

4. Non-Refundable Items
The following are non-refundable: third-party software licenses procured on behalf of the client, domain registration fees, hosting setup costs, and any work that has been delivered and approved by the client.

5. Refund Process
To request a refund, contact us at [email protected] with your project details and reason for the refund request. We will acknowledge your request within 3 business days and provide a resolution within 14 business days.

6. Dispute Resolution
If you are dissatisfied with the refund decision, you may escalate the matter by contacting us in writing. We will review the dispute and provide a final decision within 30 days. Unresolved disputes shall be subject to the jurisdiction of the courts of Denmark.
